These Terms of Service ("Terms") govern your access to and use of the OffPeak AI browser extension, website, and related services (collectively, the "Service"), operated by Ruojin Wu, an individual, doing business as OffPeak AI ("OffPeak AI," "we," "us," or "our"). By installing the extension, creating an account, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
OffPeak AI is a browser extension that uses real-time electricity grid data to identify high-carbon "peak" periods and nudges you to delay or reconsider AI chatbot usage during those windows. You may always choose to continue, bypass a nudge, or queue a request for a later, cleaner time — the Service is designed to inform your choice, not to permanently block access to any third-party AI tool.
The Service estimates carbon impact using third-party grid data (currently provided by WattTime, limited to the CAISO_NORTH region, with a time-based fallback elsewhere). These estimates are approximations and are provided for informational purposes only; we do not guarantee their precision.
You must be at least 13 years old to use the Service. If you are under the age of majority in your jurisdiction, you may only use the Service with the involvement of a parent or guardian.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us promptly if you suspect unauthorized use of your account.
Certain features require a paid subscription, billed and processed through Stripe. By subscribing, you authorize us to charge your chosen payment method on a recurring basis until you cancel.

The Service interacts with third-party platforms (including ChatGPT, Claude, Gemini, and Perplexity), authentication via Clerk, payments via Stripe, and grid data via WattTime. We are not responsible for the availability, content, or practices of these third parties, and your use of them is governed by their own terms and policies.
The Service, including its design, code, and branding, is owned by OffPeak AI and protected by applicable intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or brand assets except as necessary to use the Service as intended.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT CARBON/GRID DATA WILL BE FULLY ACCURATE OR CURRENT AT ALL TIMES. CARBON SAVINGS ESTIMATES ARE APPROXIMATIONS BASED ON THIRD-PARTY DATA AND SHOULD NOT BE RELIED UPON FOR REGULATORY, COMPLIANCE, OR SCIENTIFIC REPORTING PURPOSES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OFFPEAK AI AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service if you violate these Terms, engage in abusive behavior toward the Service or other users, or if required by law. Upon termination, your right to use the Service ceases immediately; provisions of these Terms that by their nature should survive termination will continue to apply.
We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above, and where appropriate, communicated to you directly. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the State of California, without regard to its conflict of laws principles, unless otherwise required by applicable law in your jurisdiction.
